Your agreement with us
These Terms and Conditions (“Terms”) are an agreement between you and Jase Digital LTD (“Jase Digital”, “Cherry”, “we”, “our” or “us”). They apply when you download, access, subscribe to or use the Cherry mobile application, this website or related services.
By using Cherry, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the service.
Nothing in these Terms excludes or limits consumer rights, remedies or liabilities that cannot legally be excluded or limited.
Eligibility and personal use
You must be legally capable of entering into this agreement. If applicable law requires another person to agree on your behalf, do not use Cherry until that agreement has been given.
Cherry is licensed for your personal, lawful budgeting use. It is not designed for business accounting, client-money management, regulated financial activity or emergency decision-making.
Your licence to use Cherry
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use Cherry on devices you own or control, subject to these Terms and the rules of the app store from which you obtained it.
You may not copy, sell, sublicense, rent, distribute, reverse engineer, bypass technical protections or create derivative works from Cherry except where applicable law expressly permits it.
Cherry, its interface, branding, software and original content belong to Jase Digital or its licensors. These Terms do not transfer ownership of that intellectual property to you.
Budgeting information, not financial advice
Cherry organises information that you enter and may generate summaries, trends or suggestions. It does not know your complete financial circumstances and does not provide financial, investment, credit, tax, accounting or legal advice.
- Amounts, categories, projections and insights may be incomplete or inaccurate.
- You are responsible for checking entries and making your own financial decisions.
- Do not rely on Cherry as your only record of balances, bills, tax information or payment obligations.
- Seek an appropriately qualified professional when you need advice.
Your data, device and backups
Cherry is local-first. Core budget and transaction records are stored on your device rather than in a hosted Cherry financial account. You are responsible for maintaining access to your device and protecting it with suitable device security.
Backup files
You may create a password-protected encrypted backup and choose where to save it. Keep the password and file secure. Cherry cannot recover a forgotten backup password, and restoring a backup can replace local data after you confirm the restore.
Accuracy and continuity
Review important records and keep an independent copy where loss would cause harm. Device failure, operating-system behaviour, app removal, an incorrect restore or loss of a backup password may make local data unavailable.
Optional AI, voice and receipt features
Some Cherry features use automated systems to parse speech, extract receipt details, categorise transactions or produce spending observations. These features are optional and may require network access.
- AI output can be wrong, incomplete, outdated or unsuitable for your situation.
- Review every transaction, category and suggestion before relying on or saving it.
- Do not submit content you do not have the right to use, or information that is unnecessary for the requested feature.
- Availability may depend on Cherry’s backend, a third-party provider, your plan and your connection.
The information sent for these features is described in the Privacy Policy.
Premium subscriptions and purchases
Cherry may offer Premium features through an auto-renewing subscription or another in-app purchase. The price, billing period, trial terms and included features are shown before you confirm a purchase.
- The applicable app store processes payment and may apply its own terms.
- Subscriptions renew automatically unless cancelled through your app-store account before the renewal cut-off shown by the store.
- Deleting Cherry does not automatically cancel a subscription.
- You can restore eligible purchases using Cherry’s restore-purchase control.
- Refund requests are handled under the rules and consumer protections that apply to the store and purchase.
We may change future subscription prices or included features. Any change to an existing subscription will be communicated and applied in accordance with app-store rules and applicable law.
Acceptable use
You must not:
- Use Cherry unlawfully, fraudulently or to harm another person.
- Attempt to gain unauthorised access to Cherry’s backend, systems or provider credentials.
- Interfere with security, rate limits, subscriptions, entitlements or technical restrictions.
- Submit malware, abusive requests or content that infringes another person’s rights.
- Use automated means to overload, scrape or disrupt the service.
We may restrict access to online features where reasonably necessary to protect users, service providers, security or legal compliance.
Availability and changes
We aim to keep Cherry available and reliable, but do not promise uninterrupted or error-free operation. Online features may be unavailable because of maintenance, device compatibility, network conditions, provider outages, security measures or service changes.
We may update Cherry, add or remove features, or stop supporting older operating-system or app versions. Where a change materially affects a paid service or your legal rights, we will provide notice required by law or the applicable store.
Third-party services—including app stores, operating-system features, Superwall and AI providers—are governed by their own terms and may change independently of Cherry.
Responsibility and liability
Cherry is provided with reasonable care and skill and subject to rights that apply under consumer law. We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill.
To the fullest extent permitted by law, we are not responsible for:
- Loss caused by inaccurate information you entered or an AI suggestion you did not verify.
- Loss of local data caused by device failure, app removal, lost credentials or backup files you control.
- Failures outside our reasonable control, including app-store, operating-system, network or third-party-provider outages.
- Business losses where you use a consumer service for commercial purposes.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited.
Ending your use
You may stop using Cherry at any time. Before deleting the app, export any encrypted backup you wish to keep. Deleting the app does not cancel an active subscription; cancellation must be completed through the applicable app store.
We may suspend access to online or Premium features if you materially breach these Terms, misuse the service, create a security risk or fail to maintain a required subscription. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.
Terms that by their nature continue after use ends—including intellectual-property, liability and governing-law provisions—remain effective.
Changes, governing law and contact
Changes to these Terms
We may update these Terms as Cherry or applicable law changes. We will update the effective date and provide reasonable notice of material changes where required. Continuing to use Cherry after new terms take effect means the updated terms apply, unless the law requires another form of agreement.
Governing law
These Terms are governed by the laws of England and Wales. If you are a consumer living elsewhere, you keep any mandatory protections and rights to bring proceedings that apply where you live.
